compensation for loss of my car due to a rear end accident

    I was the victim of a rear end collision and car might be an economical write off .The other driver and his insurance company have excepted full liabilty . i wouldnt be able to replace my car with what his insurance company offered .my question is this do i have any grounds for compensation for the complete loss of my car due to the other persons neglagence thanks in advance for any replys

    That sounds like more of a civil matter. maybe the boys and girls over in legal would be able to offer an opinion, but that would be all they can offer.

    Here it would be a series of educated and uneducated guesses

    You need to be put into the same situation you were BEFORE the accident happened. If its a write off, and they are offering you far lower than the expected price, dont accept it. Get as many quotes for similar cars as you can, and present this as evidence. But remember, just because YOU think its worth a certain price, doesnt mean that the insurance company need to match it. Maybe contact a solicitor if you are going to be that much out of pocket.

    The cars in great nick with only 55k on it but it is an 04 mitsubishi. Im under no illusion that its worth anything more than its market value but ive checked carzone and other sights and cant get one with that mileage and in its condition for what they offered . knucklehead i think your right but thats gonna be a pain in the arse but i might have to get legal onto it .

    The opening offer is usually below market value as it is in their best interest to pay out as little as possible. Print off a few adverts of similar cars and present them to the insurance company, stand your ground and negotiate with them.

    Dont worry i will be standing my ground and believe me i wont be bullied by any insurance company .if they want to get thick about it i also have a personal injuries claim in the process so its in their best intrest not to piss me off . thanks for your post

    I have mentioned it in another thread somewhere. But, in the past, I have had the value offered reviewed by an insurance for an economical write-off by submitting a stamped copy of the value if I were to import the car at the time. Go to revenue.ie' vrt section and see if the car's value is any better. :-) I sent the insurance a copy of the printout stamped by the Customs and they reviewed their offer to nearly the Revenue's estimation of the value of the car.

    Good news, the other drivers insurance company have decided to pay for my car to be repaired which is a relief.with only 55,000 on the clock of an 04 car. i would have never replaced it with a car with the same millage at its market value. thanks again to everyone who replied to my post
