Taking case from circuit to high court.

    Is it possible to transfer a civil case for damages from circuit civil court to high court ,ive been through PIAB and liability has been admitted by the other side ,
    But as the CC is limited to c 38k , I may be better off going to the high court .

    Yes, your legal team can move it up if appropriate. Be aware that there are cost penalties if you choose a higher court and eventually end up with damages under the High Court limit.

    Have you actually issued proceedings?

    As No Quarter advised, think of costs implication.

    If you have commenced CC proceedings you can apply by Motion to the Co regsitrar to transfet to HC.

    You would need to show that something developed such as another medical report since CC proceedings issued to justify the Motion,
