Letter from Disability Allowance

    Hi all,

A family member applied for Disability Allowance approx 2 years ago, they were refused initially and in the end it went to the Chief appeals officer.

They received a letter yesterday, and it looks as though the Disability Allowance has been awarded this time round, however the letter is a little on the vague side.

    It states:

"The appeal is allowed" and "The medical evidence supporting the application is favoured"

It doesn't straight out say whether Disability Allowance has been granted.

I don't want to get the persons hopes up by saying they've been awarded it, and i've told them to contact the office in Dublin where the letter came from however they haven't been able to get through.

Has anyone else going through / have gone through the Disability Allowance applications received anything like this, and if so, if this the letter to say they've been successful in their appeal?

    Thanks all.

Hi, I have gone through this before, albeit a few years back and was in the same position when i read the letter. I ended up phoning the department to clarify! It does indeed mean the appeal has been successful :)

"Appeal is allowed" means that your family member is going to be awarded DA in that the medical evidence was accepted. Your family members DA will also be backdated, minus any amount that he/she may have received under SWA.

What happens now is that the disability allowance application goes back to Longford, where applications are processed, and the means test will commence. So, even though the medical criteria has been refused, appealed and awarded, your family member may still be disqualified on means grounds.
Also, in my experience, just because your appeal has been allowed, you could still be waiting 6 weeks or more to be awarded, and 6 weeks more for any arrears!
