How strict are contracts

    Hi,

    Looking for some guidance - Basically looking at signing a 12-month contract for a new job.

    Only catch is that i know i will be leaving in 8-9 months to pursue something else.

    Besides not being honest about this from the start, are there any implications to not seeing out the full term of the contract?

    It really depends on the type of work. If it is a contract to finish a specific project, they are going to be rather unhappy with you leaving. It might even be possible to legally compel you to finish the work or sue you for damages.

    If it is just generic work that anyone could do, then not so much of a problem and they are simply giving a probationary period.

    Most would be understandable once you give sufficient notice, approx 2 months. My understanding is that you may legally be obliged to stay but I have never heard a case where legal action was threatened, the reality is that you could sit out your contract and do little or no work

    I actually dont know the specific type of work at the moment but i imagine it is more in line with specific project work and so it's probably going to a case of people being unhappy with me.

    To be honest this is all a bit premature as i haven't gotten the job actually but rather have put myself forward for a number of these positions. Just wanted to get general feedback.

    I think in summary it's not the right thing to do to sign up to a 12 month role knowing i won't see it through.

    I wouldnt agree that its any way unethical, its contracting so that kind of thing is actually the norm, contractors move from one job to another on a regular basis

    I don't think a 12 month contract means it's a 12 month notice period. I'd be surprised if there wasn't a standard 30 day notice period in the contract. A recruiter should be able to advise you on the norm.

    I realise you are asking in the terms of a job. But its a tenant of Contract Law that we're all free to break contracts if we want to. The recourse for the injured party is damages. A world where one could not break a contract would be a world with rampant slavery.
