Anyone Have Any Luck With DAS Appeals?

    We failed in our first appeal and are thinking of appealing a second time. Has anyone had any luck second time round? If we get rejected again does that mean we're out of it for good?

    We only ever had one appeal but it was on SFP. My oul boy was involved in a court case at the time and the appeal came up in conversation with the barrister he was using. Barrister volunteered to go to the appeal with my oul fella (court case didn't go too well I think he had a slight conscienece about the fees he had drawn). Long story short the dept officials who were hearing the appeal and the guy who had cut our SFP nearly had a stroke. Barrister immeadiately started in on the fairness of an arbitrary cut, guilty until proven innocent etc. He paid no attention at all to the facts of the case simply to the procedures the dept followed. The upshot was the meeting was over very quickly and we got 90% of the cut re-instated. I think whether dealing with banks or the dept (in the case of some sort of an appeal) it never hurts to have a professional in the room.

    TBH I have found that the dept staffs attitude has improved a lot in the past few years. If you are polite and professional dealing with them and deal with problems as soon as they arise they return the favour. If you're wrong all of the politeness in the world won't help, a couple of inspectors in our area actually seem to be afraid of their work being audited and what a bad audit would mean for them.

    How exactly are you losing it. is it because of the min stocking rate?

    yeah it was the stocking rate for us. we did buy in extra stock but i think we were too late...:(

    So what livestock units did you have, were you far off it?

    We were over the first rate of 0.15 and we are now over .30, we just didn't increase the rate in time. I think I'm right in saying you have to be over the new limit for more than 6 months?
