Caught Speeding on a Test Drive - what happens?

    This is a sufficiently funny story to start posting on this site with...(at least I think it is!)

    A mate of mine was on a test drive yesterday didn't see the signs up warning him of a speed trap and passed a speed camera van in a 60kmph zone (limit had been reduced due to road works) doing about 90 kmph (with the sales guy in the car).

    What happens in this instance with penalty points an fine etc...? I assume the car is registered in to the garage?

    I presume he should do the genuine thing and own up to it being him who was driving the car at the time.

    Would be interesting to see what would happen if the garage didn't have your friends name and address.

    good question ,I suppose if the sales guy didnt have the drivers details the garage would be held liable,could be mistaken tho,did the car have a real reg on it or the a garage plate eg 04-d-0000

    Under normal circumstances the registered owner of the car gets the fine and on the letter is a section where they can be assigned to the person who was actually driving the car (with their signature of course). In the case of a test drive unless the garage keeps details logs of who had the car out at any given time Id say that there is little that they can do to prove who was actually driving the car.

    Not sure what happens to the points. As far as Im aware with a company vehicle they go to the CEO (or someone, cant remember who) and its up to them to sort out which employee is responsbile. Not sure if a garage is the same.

    If the garage doesn't have his details then one would assume that he's in the clear!

    Thanks for quick replies and the info.

    My friend is adamant that if the garage gets the fine they have his phone number and he will do the right thing (remains to be seen).

    The car was on its own plates at the time.

    Would this have been on the Skipover Road Works in South Ring in Cork? there are Gardai van enforcing the construction speed limits there as I noticed recently. Thankfully there was heavy traffic going slow or else I would have been nailed.

    Points cannot be applied to a corporate body or to the officers thereof.
    If the company don't name anyone they get fined but can't get points as a company does not hold a driving licence.
