    Hi all,

Hoping somebody might be able to tell me what I should do. Applied for the JA at the start of June. Been told that my claim was with the supervisor since September. Thats all good. Found out the only thing that is holding up my claim is my proof of address. When I applied initially at the start of June I had just moved into a new apartment with a 3 month lease, which brought me up till the end of August as having a proof of address. We stayed on in the apartment till the first week of October before moving out due to issues with mould and the landlord not fixing things etc. You get the picture. Now here's the problem I have..even though I stayed on in the apartment after the lease came to an end. I never signed a new one with the landlord. I just payed the rent. I now have no proof of address from September till the October. Been staying with a friend since I moved out and need my back pay money to get sorted in a new place. I spoke to the landlord today and they are refusing to give me a letter to state that I lived in the apartment for a further 5 weeks. I have shown the crowd in the social welfare ESB bills from those 5 weeks but they will not accept them and told me that I have to get a letter from my landlord confirming my tenancy for those 5 weeks. I am at loss as to what to do now. They have to told me if I cannot provide proof of address for those 5 weeks then they will be forced to close my claim and I will be even more in debt then I am at the moment. Is there any legal way I can go about getting this letter or does anybody have a solution? Im desperate! Thanks in advance! :(:(

you know at the end of the day you have provided proof of address - eg esb bill for the time you lived there. do a detailed letter to social welfare outlining that you have the esb bill and explain in detail about the landlord and the fact that you have asked and he refuses to give you the letter etc. submit this and ask for the refusal at this stage - you can appeal any decision - it is unreasonable to still hold a ja claim since june and its now november, it suits them as they will close your claim and you will get no arrears. another bit of advice get on to your local td put the pressure on.

they have asked for proof of address you have given it to them - they cant keep changing the rules to suit themselves. follow through as they will keep giving you deadlines to submit but make sure you submit within the deadlines.

Was the ESB bill specifically addressed to you? Or was it in the landlords name?

if landlord is refusing contact threshold.ie. Its their forte. Chances are he didnt register you as a tenant with the PRTB and hence doesnt want to provide the confirmation of tenancy.

A TD can only put on pressure if the paperwork is in order but in this case there appears to be a legitimate delay. Stop going around in circles. Contact threshold and sort that chancer out. Once the proof of address is sorted, the put proof on social welfare to fast track the claim.
