Friends uncle got into accident, what will happen to him?

    Hey, so my friends uncle got into an accident, basically street was very narrow and while driving he went into center of road. He drives van, then a jeep came out of the turn and they crashed into each other. It's definetely his fault garda said, which I agree with. But the jeep had small kid in front sitting (even though it's not supposed to) but no one died, just injuries mostly.

    He holds a license from different country, he says penalty points don't apply to him and they can't take his license away but I don't quite believe that. So what will happen to him? Will he be summoned to court? or just insurance will pay off both cars damage?

    whilst they can't take his license away, they can ban him from driving in Ireland. It doesn't sound like it will come to that though.
    It appears the jeep driver is to blame for not checking to his right in case something was coming on the wrong side of the road.

    Sorry should've specified: it was a bend/turn.
    I think friends uncle thought street is clear and decided it's safe to drive in middle of street.

    The point that van is completely smashed and un-repairable anymore, so I assume jeep was too.

    Not sure about garda, but my friend said that when they called garda, they arrived and after all reports and official stuff said it's his fault for driving in middle of street knowing there is a bend ahead.

    By small kid I meant as between 2 - 5 years old, I think they are not meant to sit at front?

    That is only the Gards personal opinion.

    The only people who can determine who is at fault are

    1. The insurance company's, if they chose to sort it out among themselves.

    2. A Judge.

    The Garda can give evidence as an independent witness, but the drivers solicitor will have to pay for them to attend a civil court.

    The Garda can also take a prosecution against one of the drivers if he/she thinks necessary.

    Criminal court takes place before the civil court.

    they must have been travelling at speed that the van was badly damaged, as you said it was a narrow street, well people generally drive slowly through streets, safety reasons really

    In the first post you said it was your friend's uncle.
    Now you claims it's your friend.
    I think you already forgot what you written in the first post.

    Anyone can sit in the front if adequately restrained.

    Was the street so narrow that the van could not avoid driving in the middle of the road? How fast were both driving? If its a properly narrow street that is not wide enough for two vehicles where one of them is larger than a car then I would say there may be some fault on the part of the jeep driver, if they approached a blind bend too fast to slow down. You should be aware of your surroundings and drive the conditions; it sounds suspiciously like the jeep driver was neither of those...

    I am not sure of full details yet, I will ask friend more, as far as I understood his uncle just thought it's empty street, so was driving faster, to avoid hitting kerb or just for personal convienence he drove in center of road.

    Well if he was driving excessively fast for the conditions and needlessly in the middle of the road then he could be done for dangerous driving. How that will play out depends on how severe it was.

    Not really much point in speculating though unless we have all the details.

    The reason I made this thread mainly because my friend said: "my uncle has foreign license so he can't get points or taken license" which I thought is quite weird statement and definitely lacks "but"
    Now that I know he can be banned from Driving it makes sense.
