Hi i was in hospital for a month and my JA was cut off.I had to reapply and my claim was successful.Am i entitled to the 4 weeks that i missed while being in hospital?Someone told me that i am , but it was my belief that u had to be available for work.Im aware u can claim illness benefit but im unsure if i am entitled to the 4 weeks payment.

    Thanks

technically you are suppose to apply for illness benefit as soon as you become unable to work, i am not sure if it can be back dated as the certs have to be handed in weekly....however you where in hospital and unable to get out of bed

I suggest you go speak to the swo and bring a letter from your doctor/hospital with the dates you where in hospital and see what they say

when it comes to the social welfare we can all say what should happen but only the person behind the plexi glass at your local office and say what will happen so pay them a visit

If I was you I would go to your doctor and get the 4 certs needed to claim Illness benefit and send them into the address on the certs.Attach a note stating you were in Hospital and unable to forward them earlier ,there should be no problem getting paid.
    You need a MED 1 and 3 MED 3 certs .

Every GP has them but you should go to your regular doctor because they would know you were in hosipal and the reasons.Just tell him you need social welfare certs, they will know he story, as they would be filing them out every day of the week.

Plus which you were entitled to 35 euro per week while you were in hospital, if you were not entitled to illness benefit. This is to cover the cost of stuff like shower gel... that you need in hospital. Someone should have made a claim to the CWO on your behalf, as you were in hospital and obviously unable to claim yourself. You could go to the CWO and ask for it to be paid now, in arrears, so that you can pay back any money you borrowed off family when you were in hospital.

For future reference, if you are in hospital again, ask to see the social worker, and she will sort out the 35 euro per week for you. Or else get a family member to go to the CWO on your behalf.

If your illness is long term, apply for Disability Allowance and Invalidity Pension, as well as the illness benefit. If you qualify for any one of these three, it will continue to be paid if you are in hospital, so they are much better if your illness is likely to recur.

A quick note...the fact you are on jsa may mean that you will not qualify for illness benefit..if this is the case you will receive a letter from Illness Benefit section stating this and you can go to your community welfare officer and apply for supplementary welfare allowance for the time you were in hospital.
