    once it has less than 8 passenger seats and under 3500kgs you can

    The number '8' refers to 'passengers' so excludes the driver, hence a total capacity for 9 people is permitted with a B licence.

    Category B covers the following....

    Vehicles with seats for up to 8 passengers and a maximum weight of 3,500kg (includes pulling a trailer where the maximum weight of the trailer when fully loaded is 750kg or less)


    with a footnote which says the following...

    "Passenger accommodation" means seating accommodation for passengers in addition to the driver.
