Exchanging details after a rta...

    A friend of mine recently had a small accident in his car..details not important, no injuries....the other driver refused to give her name and address other than her first name....he took the other details from her car ..he rang his insurance and they said that as long as he had her reg. no. and ins. disc details that would be fine...
    He asked a Garda he met if she was obliged (by law) to disclose her details and he too said "No"..only to a Garda...
    Is this a new development.....i was always under the impression that all details had to be exchanged after an rta...:confused:

    Section 106 of the Road Traffic Act 1961 is the law on what you should do if involved in a collision and the information you must provide.

    Basically you must provide "appropriate information" which is defined as:
    the name and address of the person required by this section to give such information, the name and address of the owner of the vehicle of which such person is the driver or is in charge, the identification mark of such vehicle under the Roads Act, 1920, or any other enactment and particulars of the insurance or guarantee of the vehicle pursuant to this Act

    You have to provide it to a member of An Garda Siochana if present and the owner of the car. Your Guard was wrong - you are fully entitled to the information.
