gardai and points question

    having trouble gettin answer to this question. some say yes and some say no. can gaurds give you points for tintedwindows on front side windows and non standard number plates. i no there both illegal for nct as won't pass for both. but can the gaurds give you points or fine if say you put them on after test.??

    I've heard of people being fined, not sure about points. Google penalty point offences maybe?

    Because if you got a **** of a guard he could follow you out to the car and give you the fine/points as you drive off

    Then walk.. or don't take stuff off for the NCT then put it back on :rolleyes:

    And a gaurd is not going to do that...

    Well ring them then. I really doubt any Garda is going to bother following you out of the station and/or chasing you down the road for this; its not like you walked in and admitted to committing a murder...

    You do have to take them off!

    What plates are they? Black?

    My car has tint taken off the front as the guy before me was in the exact same situation

    I could be wide of the mark here but a car that would not pass the NCT is deemed to be not roadworthy, and considering the Garda could see two very obvious things about your that would cause it to fail the NCT, he is doing his duty in stopping you from driving an unroadworthy car.

    I dont know how that holds up legally, but in my head it makes sense...!

    ye but having number plates and very light tint has nutin to do about bein roadworthy really. they are just visual modifications.

    no the are the normal plates just the letters are a bit bolder print .

    A tint level of that allows less than 65% of light to pass through will fail its NCT.

    In relation to number plates there are regulations that set out exactly what the number plate must look like. Any other type of number plate would be in breach of the regulations and would if AGS wish be a court matter with a fine.

    If you think a member of AGS does not have the power he claims, well then take the risk and see if a judge agrees with you. (I am assuming a member of AGS knows about the law)

    Looking at the list of offences incurring penalty points off the rsa.ie website tints and number plates are not specifically mentioned BUT it shows mandatory court appearances with 5 penalty points on conviction of driving a dangerously defective vehicle or driving before remedying a dangerous defect 3 points
    Up to you if you think the risk is worth it
    Oh yeah plus a court fine

    As far as I'm aware they have a little tester but most guards would be able to spot a tint that's too dark. It's not too hard.

    The registration plates are an offence under Article 9(7) of the vehicle registration and taxation regulations 1992, as amended.

    The windows are an offence under Article 23 of the road traffic (construction, equipment and use of vehicles) regulations, 1963. Assuming it's blocking more than 35% of light.

    There's no points. Just a straight summons if you don't rectify.

    so i cant get points but can be brought to court if i dont takethem off when told by gardai.. ok got it.. cheers.

    now is there such a tint that will let in that much light does anyone know??

    The Gardaí do not impose points. Only the courts and the RSA can.

    Not too sure,but i think anybody who tints their front windows (and i'm guessing it's a severe tint for the guards to pull you up on it) should be banned from Driving for being a tool.And as for non standard reg plates,they should be banned from walking as well for being a bigger tool.

    here mate less of the name calling, it was at a checkpoint and as i had a full window there was nutin he could get me on except tell me to change plates and take off tint on font driver and passenger windows which might i add is the light tint as there is 3 further darker tints you can purchase after mine..

    well when the issue notice, it still means your getting the points so its kinda the same thing in real world..

    Will you be making the changes? What style are the plates? Truthfully how dark is the tint? Can you see clearly out of the car in dim conditions?

    Nope.

    You are under no obligation to accept the notice. You are entitled to fight.

    Only the courts can direct the RSA to impose points, the Garda cannot.

    This is the tester the Nct guys have. I'm sure the Gardai have similar.
    I have no doubt he would have to check it with tester if he intended to prosecute you.

    its second lightest tint you could get.so its no problem seeing out. there is 3 darker tints after mine.

    The reason why they need to be of certain clarity is obvious and is not really so much seeing out but seeing in. The only thing I see wrong with tints is that the glass doesnt break the same way as it would if it didnt have tinted windows. Normal glass breaks in tiny little pieces while laminated tints (not sure if there is another way of doing it) make these little pieces stick together so if they need to pull you out of the car (ie after an accident) it might take longer than normal to get you out of there.

    Yes, seeing out is important, but seeing in is also important ie Gardai, etc

    Now I am not sure if it is the same here in Ireland but were I am fron it is, specially front windows. In fact, you are only allowed to tint the rear and rear side windows.

    Factory tints are different, I believe the glass is treated in a different way, is like the glass is "smoked"... maybe I have used the wrong analogy... :)
