Change of Ownership advice please

    Lads,

    I would appreciate some advice please.

    I am hoping to buy a van from a friend of mine. Taxing it as commercial is no problem.

    The issue is the log book/registration book is lost. The present owner did not apply for replacement documents as he moved address and he has incurred a parking fine and a Gatso speeding notice which he suspects have gone to his last address and more than likely been returned to issuers as he never gave a forwarding address when the rented house was sold.

    Now, he is afraid that if he applies for a new log book in his name so he can transfer ownership to me the fines and points will catch up with him.

    My question is 'Do any of you noble and wise Motor Heads know of a way around this please - so I buy the van and the buddy doesn't get the points etc?:)

    My understanding is that the points for speeding go on the registered owner's driving licence irrespective of where the notification is posted to so he already probably has the points on his licence.

    The cops send the notices to last address on record. A summons would eventually issue to that address. The cops cannot issue points and points cannot be attached to any licence without the cops or courts having the licence number. Without a licence number they can do nothing.

    So basically to avoid getting points all you have to do is not bother updating your address with Shannon if you move? Seems a daft loop hole to me but not suprising with some of the laws in this country.

    It is not a loophole just an unintended consequence of their procedures.

    However, it doesn't advise on how myself and the seller are going to overcome the lost logbook and he doesn't get points. Any help welcome. Thanks!

    The fines are not attached to the car so there are no worries on that score.

    It is up to the courts/cops to find him.
