Lost Log Book with a Twist

I've had a search around but couldn't find anything similar in past threads. I need to have a final look around, but it's looking more and more like I've lost the log book to a car I've just bought. The twist is that I hadn't yet sent it away yet so it's not in my name. I know it should have been sent by the owner straight away, but it wasn't so I now need to deal with it :o

We're in the middle of moving house, so it's likely it's packed away somewhere, but on the good chance that it isn't what's the best way of getting the it back? If I apply for a new book to the tax office it'll obviously go to the previous owner, and I don't think I still have his details. Any fail safe in place for stupidity?

yea you'll have to bring the car to a dealer and get the the chassis and engine number confirmed then go to the cop shop and fill out some forms and sign some stuff.

    no biggy

Oh these things happen and could you maybe ring Shannon on 061) 365 000 and they should let you know exactly what to do. Think there is a form you need to get signed/stamped at your local Garda station stating what happened to the original document.

It's a bit more involved. You've to ring Shannon to get this form, go to a main dealers to get the VIN verified, go to your solicitor or a commissioner of oaths to witness a declaration that the car is yours, go to your local Gardai to get all this signed off, post the completed form to Shannon and wait for them to contact the previous owner to confirm they no longer own the car (and hope that they reply, and don't complicate matters by claiming they never sold the car). It won't happen overnight :D

Why do you have the previous owner's logbook to begin with?

Why didn't the previous owner send it away to Shannon?

Thanks for the replies so far. I was given the log book when I bought the car to send off (I know this isn't the correct way, but here we are) - I made a few scans of the new owner details page to keep in the tax disc holder to prove I'd just bought the car and I still have these but they just have the previous owners name, no contact details. I've tried a quick Google in case it showed anything up but no joy.

Cheers Dougie - I rang the tax office in Shannon and that's exactly what they told me. The form is being sent out today, so if it hasn't showed up by then I'll kick off the process.

    A few questions:
    - Will there be a charge involved with the dealer/Commissioner of Oaths to have the VIN number checked and signature witnessed? I'd assume there would be, so just to confirm.
    - I've already transferred my insurance over temporarily when I bought the car so I could move it home for a few bits and pieces to be done before the NCT. Should my insurance company be able to permanently transfer my insurance onto the car pending ownership being transferred?

Both the garage and the commissioner could well charge you, I've read that the commissioner or a solicitor should be in or around €20-30 max. The garage is anyone's guess :D

The question the insurance ask you when you want to transfer is "do you, or will you, own the car", so I would think they'll transfer no problem. Do you have any receipt for the sale of the car? This might be important if there's any complications.

If you go to the local court the comm. for oaths is free.

Thanks - I'll give a call around to a few local dealers today to see if there's a standard cost for this.

No receipt for the sale of the car, but I do have a photocopy of the logbook signed by both the seller and I which would probably be a good indication of the sale being made :p

Thanks again - do you mean if I just show up at the local court, the Commissioner for Oaths is available to witness signature for free? How do I find the relevant court?

Quick update on this - I've been on to the local Nissan dealer here who were very helpful - dropping down at lunch time and there'll be no cost if the Chassis number can be confirmed from the bulkhead. If not, it'll need to go up on a lift I guess and we'll see what that costs.

Is there any more info on the local court to have the document signed by Commissioner for Oaths?

Any circuit or district court will do, most solicitors will do this as well for a fee of about €10

Cheers - I got in touch with a Commissioner for Oaths/Solicitor close by who'll sign it for €10 this evening. This is a lot less painful than I thought it would be. Had visions of paying an hours labour to Nissan and €50 or so for Commissioner. It's standing me €10 and a stamped envelope to Shannon total. Insurance transferred over permanently also - no issue with insurance company.

I am in a similar situation, I bought a vehicle last february without a log book. I was told that the previous owner had died also, will this be a problem when Shanon try and contact him? Is there another way to get the vehicle in my name, I have it insured without a problem?
