    Hi All,

    Say if my nanny died 12 years ago and made a will leaving all her land, property possessions to her sons and daughters but that her Will never went to probate... how does that leave things?l..........

    It leaves things so you have to do the probate so that granny's intentions can be realized. "Probate" is a process where the Probate Office (a bit of the High Court) looks at the Will and confirms what it says. It then issues a piece of paper that can then be used to authorise the transfer of the land into the names of the beneficiaries, or to deal with bank accounts or shares or whatever.

    ... BTW, your granny will have named an "executor" in her Will. This is the person who is responsible for dealing with the probate. If that person hasn't acted or refuses to act, or is deceased, the beneficiaries will have to make other applications to the probate office to deal with that first. You should go to a solicitor for advice, or if you're up for it, go straight to the horse's mouth: the Probate Office (in Smithfield) has an information section for members of the public.
