Ebay/Paypal Claim. where do I stand?

I'd really appreciate some advice please.

Basically, bought something expensive from a reputable Ebay seller in the UK.
It was sent Royal Mail Airsure but they actually LOST the package!:eek:According to their tracking info. it arrived into Ireland but An Post are saying that it never arrived in! The tracking info. stops dead on the Royal Mail website.

I paid for the item by Paypal.

I am going to escalate the dispute to a Paypal claim. However, under the seller's returns policy on the Ebay listing it states the following:
"Damaged or Lost in Shipping: Items damaged or lost in shipping must be confirmed by the shipper. Hold the item, original packaging and contact us immediately. You will be refunded only after the claim has been approved and paid by the shipper."

Does this mean that I have no hope of getting a refund until Royal Mail reimburses the seller??? This could take months!!! I thought there was a cut off timescale for Paypal? Or will Paypal refund me regardless of this paragraph in the ebay listing?

Thanks, I am kind of freaking out here as I will be at a substantial financial loss!

Start a dispute with the Paypal, let the seller do all the chasing after missing parcel .

Your dispute is with the seller, escalate the paypal claim and paypal should refund you from the sellers account. It is up to the seller to claim off the Royal Mail but this will have no impact on your claim against the seller via paypal.

Did you contact the seller/ they might offer to send you a replacement item or refund the money, I only go to Paypal if seller doesn't cooperate.
