Insurance (Claim) Advise?

    I was involved in an accident at the beginning of August this year (when someone reversed into my car in a car park). There was minimal damage and the other driver admitted they were in the wrong at first. When we were getting insurance details the other driver decided that she did no wrong. There were no independent witnesses.

    I put in an insurance claim against their insurance, as I was under the impression that they were planning to put a claim against mine. I wanted to make sure I did not imply that I did anything wrong in the accident.

    Turns out the other driver did not put in an insurance claim in against me.

    The assessor (from the other drivers insurance company) came out to check my car and their car, and concluded that the damage sustained to my car was not as a result of the accident. I had no damage to my car prior to the accident...

    The other insurance company came to their conclusion at the end of August, but they never informed me. I had to ring them today to see what the status was.

    The company effectively said I was lying, but in the same breath said they weren't reporting this as a false claim.

    I am so mad that the other driver was able to reverse into me, then lie through their teeth, and I am the one who suffers the consequences.

    Do I contact my insurance company and get them to go after it, or do I just walk away as the damage was minimal and does not effect the day to day running of the car?

    That's why your meant to call the guards. When you manimal, how much was the repair?

    I know from past experience that the guards won't come unless someone is injured.

    I took photos and stretched the scene.

    The max damage on my car is 400e but this was a quote from a well known crash repair garage (who the insurance company wasn't happy with).

    Not true. I had someone sideswipe my car last year in Cork City. Fortunately, I saw him do it, caught him and called the Gards. They came pretty lively. I was most impressed!!

    A family member was involved in an accident last year, when the front of their car was completely destroyed after another vehicle ran a red light. After ringing the guards they were told that as no one was injured there was nothing they could do.

    But the accident will be recorded. Also 400 is too small for a claim. The excess would probably be 250, so claim.is 150 which would put up a premium. Surprised the other party didn't just pay for the repair.

    OP - when I was last in a car accident I dealt only with my own insurance - I never dealt with the other party's insurance company.
    My company did all of the negotiation and instructed me not to contact the other person or their company.

    Can I suggest you call them now, it might also be worthwhile contacting the Insurance Ombudsman of Ireland.
    Not sure what the process is now that the other company have come out with this malarky but you never know.

    I did contact my insurance company. They informed me to report the accident with the other insurance company.

    Later on they closed the claim, as there wasn't a claim against my insurance.

    At the time I told them I was unsure of the outcome of my claim against the other driver, and my insurance company only offered to put my claim against my fully comprehensive insurance (I declined as I am not increasing my insurance for the other drivers stupid driving).

    I had suggested at the scene that as the damage was minimal there mightn't be a point claiming and we may be better off just settling it ourselves. The other driver dismissed this.

    Wow - in my case my insurance company handled it all...
    Maybe then get onto the ombudsman or get back onto your own company - you are paying them a premium for a service - in my basic view they need to provide this, but check with the regulator first, they are bound to have a complaints process.

    OP - My husband was involved in a car crash last November. He was stopped in traffic and another driver ploughed in to him causing him to crash into the car in front of him.

    The Gardaí were called and they confirmed at the time that the driver who crashed in to my husband would be liable for the damage to his car as well as the car he crashed into.

    We reported the accident to our own insurance company and they recorded details of the accident but they left it to us to deal with the other insurance company. To cut a long story short we had huge issues with the insurance company's handling of the claim, they asked us to supply three pre-crash valuations (from main dealers) and when we did, they were only prepared to offer us €1,500 less than the main dealer's valuations.

    It was only when we wrote to them to ask for a copy of our claims file and advised them that we were going to lodge a complaint with Insurance Ombudsman that they eventually settled. It might be no harm to inform the insurance company that you are not happy with their handling on your claim and you would like them to send you a copy of your file so you can have it examined by a third party, it might get them thinking. Given the low claim value they might be anxious to settle as a referral to the Insurance Ombudsman can be quite expensive for an insurance company.
