    Hi all,
    I posted recently about a new position I have been applying for, but I just need to check something.

    I am through to the final round for this position, but the position starts next Monday. I currently have to give one weeks notice in my contract (as I am there only there 3 weeks). If I do get this job, I will not know until tomorrow, meaning that I have very little time to submit a notice (ie one day). I am wondering what can be done. I am not a type or person to walk out on a job, but I have a choice of a permanent position versus a temporary contract that is due to finish in a few weeks anyway. Any advice would be well received.

    EDIT: I should mention. I only received my contract recently, and as of yet it has not been returned/signed by myself.

    According to this:

    "If an employee has been working for an employer for less than 13 weeks and has no contractual obligation to give notice then the employee is not obliged to give notice."

    I am not a lawyer (as you know antodeco!) so I don't know if "I haven't signed the contract yet" means "has no contractual obligation".

    I was researching as much as I could, and there's an 'implied acceptance' of all contracts. This is why they call them 'terms of employment' rather than 'contract of employment'. However, as I am there such a short time, I wonder what the stance on this actually is. Now technically, the worst that can happen is a bad reference but I wouldn't be looking for a reference off them anyway!

    I would just leave the current job if you get the other one.

    Remember, 99.9% of jobs are quick enough to run you down the road when times are bad. So one shouldnt have loyalty to the job. So i'd just quit if you get it man.

    Very shoddy of the company hiring not to give people enough time to work notice. You're going to have to be equally as shoddy if you get it in letting down your current employer. Personally if it was a temp v permanent I'd have to admit I would probably take it.

    EDIT - the worst they could do is sue you for damages in breach of contract actually. Chances that they would are very slight.

    I've never once shafted an employer before which is why this is difficult for me. It's a choice of temporary work in a very small company, to a permanent role in one of the biggest companies in the world. On top of this, my current working conditions are terrible and I doubt very much I'd leave a huge gap (even though I'm in a specialised role).

    Yep, sounds very unreasonable of them to expect a turnaround of just a few days.
