Can someone tell me 100% how long I have before the gardai can take my car for having no tax.. People are telling me different things some say 2 weeks and others 3 months??

How long do I really have?

AFAIK it's two months before they take the car. You're liable to get tickets from the moment the tax runs out.

Technically they can the 1st of the month it is out. They usually give a months grace, but after that they can. I have seen a few cars lately that looked like they were taken for no tax.

A months grace and then a month out, so 2 months before they can take it???

The law allows them to seize your car for a no tax offence only if your tax is out by more than 2 months. There is no authority to seize for tax offences before that 2 months period (perhaps those cars were seized for no insurance).

From the moment your tax expires you risk being fined if your car is found driven or parked in a public place. Most Gardaí tend to use discretion if it's in the month of renewal but the OP should be aware there is there is no grace period in law. And watch out for Traffic Wardens, they can fine you too.

if the tax disk is expired two months it can be seized.

if there is no tax disk displayed at all it can be seized.

if the tax is out at all you can get a ticket.

all of these options are at the discretion of the guard stopping you. in some cases you may get a warning, others a fine or they may seize of the car.

And you'll have to pay the back dated tax when you do pay.

I've gone 6 months with the tax out and I managed to just get a fine. I was on the way into the city to declare the thing off the road as well! Sickened.

What were you going to do when you got there?

Declare it off the road, then get the bus back?

Just offering a different opinion to "sickened" why should he get away with dodging it for 6 months?

People who don't pay their car tax / insurance and then give out when they get caught baffle me.

If you can't afford to pay it then you shouldn't be driving. Simple.

Yeah, and it affects me too. It's our money, remember?
