    I have worked in <<a cafe>> for over 2 years and have just found out my

    employer isn't paying me my holiday pay or my week in hand AND hasn't
    been paying my PRSI!!!!
    which now means not only am i unemployed and broke but im not entitled
    to claim my stamps from the social welfare!!!
    How do these crooks get away with this! If i didnt pay my bills I would
    end up in jail but <<someone>>, the owner! gets away with it hiding being a
    limited company.
    I also just heard he didn't pay any of his suppliers and owes the
    revenue a fortune too. What kind of legal system do we have in this
    country!!!!!!!

    No. He may not get away with it. The limited company structure will only protect someone if they've been above board. As a company director he may have broken all kinds of rules, so various people may come after him and try to take the shirt from his back.

    OP, I agree, that fairly sucks.

    I've taken the identifying information out of your post: much though I sympathise with your desire to get his name known out there, the risks to boards if he decides that you are "libelling" (of whatever) him are too great.

    In terms of your benefit situation, I'd suggest a trip to Citizen's Information: hopefully they can help you sort through redundancy entitlements - if the owner/company can't pay, there's a way for the state to do it.

    If your stamps haven't been paid, then you're not automatically entitled to JB. But depending on your means, you are entitled to Jobseeker's allowance or supplementary allowance even without stamps paid. So persist, there is a way to sort this. In fact, if you want, report this post and we'll move the thread over to State Benefits where they will know more of the detail.

    And in terms of how employers get away with it, I'd suggest visiting your TD and complaining. End of the day, it's the politicians who make the laws which enable people to operate in this way, and they are the ones who need to get them changed.
