Small claims court North and South of the border

    Hello everyone!

    Could anyone advice me on the procedures for small claims court in the North against someone living in the South.

    For example rent arrears, If someone is living in the South and has received correspondence from the Belfast small claims court does it have jurisdiction down here??

    Also if the amount being sued for is larger than the amount owed can it be fought?

    any help would be appreciated on this matter!

    Was the property rented in the South? I would think this would be a matter for the PRTB.

    I assume from the OP that the claim is in the North, but the respondent lives in the South?

    I think advice had better be sought from a solicitor in the North who is experienced in property. No-one in the South would be able to assist as the law's different here (I assume).

    I do know if you fail to answer the summons, then a judgement against the respondent will be entered in their absence. Other than that - you'd better speak to a brief!!
