PayPal - Ombudsman - outside jurisdiction

    I’ve had a dispute with PayPal for 6 months (documented elsewhere on Boards) with no resolution. I decided to seek assistance from the Financial Ombudsman Dublin. They wrote back to me saying that as the PayPal company is registered in Luxembourg PayPal fall outside the jurisdiction of the Financial Ombudsman here. I found this surprising and imagine that a lot of PayPal users in Ireland might not know this and thought I might share.

    I was advised to send details of the case to:-

    Commission de Surveillance du Secteur Financier
    110, route d’Arlon
    L-2991
    Luxembourg.

    Hi the watchman, I have used Paypal for years until I had a problem. I bought an item on Ebay and paid by Paypal. But it arrived damaged and I have followed all the procedures and provided all the documents to Paypal, but it closed my case, saying:
    "Status

    After careful consideration, we're unable to decide this claim in your favor at this time.

    The documentation you provided didn't follow the guidelines. Supporting documentation must be from an unbiased third party and on letterhead that includes adequate contact information.”

    Do you think I can not go to the Ombudsman ? Do I have to go to the small claims court? What is the result of your case?

    Hello Jen , sorry its taken so long for me to reply.

    I think it is worth taking your case to the Ombudsman. Just write a letter giving your side of the story with copies of documentary proof to support your case. The ombudsman will initially say something like “we’ll ask Paypall to take another look at your case”. Wait and see what happens.

    Word of warning though. PayPal is not above telling lies to the regulator. They have no fear of them.

    My case was resolved in my favour. However after it was resolved I found out that PayPal lied to the regulator and said that I had made some errors when topping up my account. I am absolutely furious at this and have spent a lot more time gathering evidence that I did nothing wrong and have sent that to the regulator and ask that strong action be taken against PayPal over this. Its been a couple of months and I have heard nothing. Starting to look like there are some things that the regulator will help you with and some things they won’t….they probably got a cosy relationship and don’t want to rock the boat…where have we heard that before lol.
