Is there such a thing as a defacto contract?

    If you are working with out a contract is there such a thing as a defacto contract that would cover things like notice period?

    Just found information relating to min notice set out on the citizens information website.

    I was a contracted employee. My contact ran out in 2011. I got a pay rise since then and my job description has since changed. I am confused as to what my notice period should be.

    I am in the job more than two and less than 5 years. My old contract states 4 weeks but the terms and conditions of that seem no longer to apply.

    My understanding, you now have an assumed contract, based on your previous one. Contact NERA for absolute advise. They do, actually, have all the answers.

    Yes there's defacto contracts but they are obviously harder to enforce (both ways). Having said that if you had 4 weeks before and have not signed anything else then that's what I'd run with that when handing in the notice or if you got a bit of flexability to discuss with your boss before writing down the final date on paper.
