maintenance payment

    Question for a friend

    Can a spouse themself's stop a weekly maintenence order that was inforsed by the courts too be paid weekly but took upon themself's too pay it monthly due to the fact that they are getting paid monthly? they have the money to pay it weekly but are choosing not too

    If the court has ordered weekly payments, that's the way it must be done.
    To change it, an application must be made to the court.

    Paid at the beginning of the month for the whole month.

    To be honest I would see it as a waste of time and effort to bring this issue to court. In my experience judges are reluctant to punish fathers who don't pay anything at all. If a father is paying the full amount every month i doubt a judge would do anything but alter the payment schedule to take account of the fact the father is paid monthly.

    This sounds more like a budgeting problem than a legal one

    Are they paying? You say in your OP they are paying monthly which is not what was agreed and appears not to suit you.

    Paying monthly and not paying at all are two different situations

    they were paying weekly, decided themselves too break the court order and pay monthly instead, i have been told the person in question now will not pay even monthly that they are fed up paying, as stated this question is for a good friend of mine and not me
