Awful insurance mess advice needed!

    Ohhh where to start ,

    I'll try and explain this as easily as possible. I had an insurance policy last year on a car. I sold the car on a Friday evening on adverts.ie, car picked up friday evening and off it goes , guy who turns up told me he was selling it on later that night and he'd sign the log book over (He was making a few quid extra on it)... Car is crashed thar weekend into the back of a taxi and the driver runs from the scene, car still insured under my name as I haven't had a chance to cancel the policy yet.

    Guards turn up at my house and I prove that I'd sold the car and wasn't involved. Skip forward almost a year and I get a letter claiming on my insurance for 2 people claiming personal injuries, I inform my ex insurer who the car was with ,they send an assessor and I go through the process to prove my innocence , withnesses , signed letters , guards report etc.

    Issue is then referred back to the injury board and I'm told I'm not going to be affected and will keep my NCB. I buy a new car just last month as I've been driving a bike (Baby on the way car needed) and now I'm having awful trouble getting insurance as nobody will ensure me with the claim open against my name.

    I've called the RSA and 123 almost everyday trying to have this sorted and I still can't get anywhere with it. Old policy was with 123 and underwritten by RSA new policy is with best quote and underwritten by RSA but best quote won't accept my 4 years NCB with the claim open and I'm pulling my hair out at this stage...Ombudsman at this point?

    Has your "ex Insurance company" admitted that you are not liable to the old claim? If so, they are legally required to keep the information that they maintain on you up to date, under the Data Protection Acts 1998 and 2003.

    I'm not a solicitor or attached to the legal side of things at all.
