Rear ending.......who is at fault?

    Interesting case for a knowledgeable legal expert.
    Person A was driving along c20 kmph in a built up area and without warning a passenger started to get out of the car in front!!!!...which is still driving in the middle of the road!!! Person A steps on the brakes and tips the bumper of the car in front,causing a little damage to both vehicles.The police come to the scene and arrest the passenger of the car in front who was under the influence of something and was the cause of the accident. Few weeks pass and the driver of the car in front gets a solicitor to issue a letter for damages to person A...and also issues a letter for damages for a minor who was in back of car to person A also...............There is no mention whatsoever of the person that caused the accident who was alighting from a moving vehicle and who was derogatory to Person A........and of course was subsequently arrested.!! The people concerned would be from an ethnic minority (a sense of humour is required!!!) background and the gent in question would have a string of convictions...does it make a difference? Is there some sort of scam going on with people claiming insurance etc etc ? What shall the outcome be?

    Yes, yes the law is different for those pesky ethnics, they get the death penalty while the rest of us get away with it yahoo!

    Person A needs to go see Mr. A (he is a solicitor).

    Isnt this what insurances is for? Pass the letter on to them and let them deal with it.

    Make sure they know all the facts. His race isnt a fact(or)

    God some of the replies are so picky...not helpful like my UK forums,I just tried this to see the Irish angle on things and some of the sarcasm stinks.Thanks to those that tried to help,to the others: a moderator may be in touch!;)

    not quite sure if you're actually serious here but in any case person A is at fault for the accident.

    you drive at a speed that you can safely stop your vehicle should something happen in front of you.
    doesnt matter what happens in front of you ( unless someone throws the car intoo reverse!) you should be driving slowly and at a FAR ENOUGH DISTANCE to stop safely.

    person A responsible.
