Golf handicap dispute

The court judgement in the Hermitage GC case was given yesterday - against the ex-member, who will be unable to pay the enormous legal costs involved; it seems likely that the club will have to pay, as the plaintiff has no money.

Whatever about the rights and wrongs of the case, the club should have included in its Rules/Memorandum and Articles of Association (or otherwise) a condition, of membership, which prohibits legal action against the club by members - in cases of dispute.

This happens in the IRFU, FAI and GAA - where an independent arbitration proceedure is used; this is much quicker and cost effective.

The Hermitage GC case will now go to appeal!

Golf - and other clubs, take note...

    :(
