Renting Problems

    Three friends and I have put a deposit on a house in Ranelagh and have signed a 10 month fixed term lease which is due to start August 1st and end on May 31st. The only reason we are renting for August is so we have the house for September and avoid the August rush to rent a house. However today I spotted that the same is house is for sale on daft. I'm wondering where do I stand legally with regard to the lease I have signed. Could the new owner kick us out even though we have signed a fixed term lease? Is the landlord in breach of the lease by selling the house and not giving us notice. It's very difficult to figure what rights we have. Thanks

    If he is selling the house, as in not putting it up for let, that should not affect your lease. The new owner should know that the house already has tenants. If you re-read the contract you signed it should make matters clearer. If the house is up for let on daft, then yes, that is a breach of your contract as far as I am aware.

    The landlord can end the tenancy in order to sell the property, but must give proper notice. See here:

    Also, if they are trying to sell the property, they might want access for viewings. I don't think they are legally entitled to that, but it could lead to more hassle.

    However, it's entirely possible that they've decided not to sell at this time with the property market the way it is and they might be happy with you being there for the year.

    Yes but that's for a Part 4 tenancy, I have fixed term tenancy, I'm pretty sure that that gives me more rights???
