Help For Stamp 4 Owner who is being physically abused

    Hi

    I am really emotional whilst writing this, so please forgive me...

    My sister has been with her Irish partner for 6 years and they have recently had a baby together. My sister however has been suffering from emotional abuse over the years which has recently led to physical abuse in the past.

    The Domestic Violence took a nasty toll this evening due to my sister finally deciding enough was enough. The Gardai were called and advised her to get a barring order which will not allow him to see the baby or get a barring order which will get him arrested if he displays any abusive behaviour. My sister will be getting barring order number 2 tomorrow as she wants her child's father in her life, naturally.

    My sister would love to leave her partner but feels she cant as he is supporting the family financially since she is not working. Her Stamp 4 is up for renewal next month too. As a result she needs her partner to go with her to emigration to get it renewed but we dont think he will as he checked out of the relationship but more importantly doesnt care about his child based on his recent behaviour.

    Is there any assistance my sister can get from anywhere. We really don't know where to start as there is a 4 month old baby's life at risk??

    Hey there,

    I'm afraid we cannot give any kind of legal advice.

    I think your sister would be best contacting her INIS immigration officer personally and explaining the particular details of her case and ask where to go from here, if the conditions of her residency have not already been clearly set out in her original decision letter. Immigration policy can be complex at the best of times, throw in recent ECJ rulings and the police intervention for spousal abuse and I think you are best getting the info from those that have all her details and will be processing any immigration documentation.

    It might also be worth contacting Legal Aid to see if she can get help on the legal ramifications.

    You say your sister wants to stay with this man for financial support reasons and that she wants to keep him in the childs life?
    Seriously, her and the childs physical safety are a much bigger priority than money and visas.
    Would she be better off going back to her home country if the risk is so great? Can her family help support her and the child there?
    If he has checked out of the relationship and doesn't care about the child as you say, then going back home might be best for them, if her family will help support her of course.

    I advise getting in touch with the Citizens Advice Centres around the city immediately (!). Each centre have special nights each week when solicitors come in and give free advice. You need to make an appointment in advance. ... call around a few centres to see if they have an immigration solicitor on a specific night though !

    Also - my advice is to visit more than one - for a second opinion.

    The Legal Aid board will help you apply for legal aid for if or when you actually go to court, and the waiting list is > 4 months.

    Sorry to hear about your sisters situation. Immigrant Council of Ireland are excellent in these situations and experts in their area which includes leave to remain and stamp 4 etc.

    They also have an in house solitictor who can act for people in limited cases but at least you will get relevant advice. The information officers are great at assisting with any letters that might need to be written to assist with renewal of Stamp 4. Their number is 01 674 0200 and their website is http://www.immigrantcouncil.ie Do ensure you get to an Information Officer though, not just the first port of call...

    If you read my post I questioned if her family were in a position to help with financial support. The OP did not say that there was no-one in the family or extended family, friends who could not help the lady and her child.

    The OP said the babies life was in danger. If she believes that is an immediate risk then surely that is the most obvious question to ask rather than staying with the guy and figuring out visas :confused:.
