Question regarding rights after purchase of vehicle

    Hey guys,

    Quick question. I bought a second hand car back in Feb. According to the documentation supplied, the engine was replaced in 2011 by a garage in Wexford. The seller told me this and there is a stamp in the service book to verify this. However, he told me that the engine that went into the car was a 2005 130bhp engine rather than the standard 115bhp. He said that he would get me paperwork to verify this as I wanted to know the details regarding the millage on the car as it stands.

    He never got back to me with the information. I did not mind this because I had the stamp from the garage. So I rang the garage back in May and after several calls, somebody answered. When I explained what I was after he became vague. However, he said that he would check and to ring him back.

    I rang him back later that day and he told me that it replaced with the same spec engine (so 115bhp and not 130bhp) and from 2001. This conflicts with what the buyer told me. (I do not have the buyers number anymore to ring him about it.) The garage owner said that he would send me out the details on headed paper. I gave him my details and left it at that. Suffice to say, he never sent them.

    I was going back over the paperwork the other day and I noticed that the guy who sold me the car went by the name of Murphy. Also, the owner of the garage where the engine replacement was carried out is also a Murphy. So I believe that they are father and son.

    So anyway, after repeated attempts to contact the garage, no answer. Basically, I do not have a problem with the car, it is going along fine. However, it would be nice to know what engine is in it and what the mileage is.

    I am thinking of taking a trip to the garage next week to see if I can talk to somebody in person. My question is:

    Do I have any case under the Sale of Goods and Supply of Services Act 1980?

    The car is potentially not as described. For all I know, the engine could be the same one from 2001 with 200,000 on the clock. They could have just backdated a stamp and put it the book.

    Any advice or suggestions?

    If you bought Private then pretty much, no .

    If you bought from a dealer then you might have a case, if you can prove thats what he advised you of. (i.e. get him to admit it, or have it written down)
