Hi in my job we have a on call service this runs from 23:00 - 07:00 weekdays and on a Sat from 13:00 all the way trough Sunday until Monday at 07:00.

There was never issues before as people has no issues doing it. But getting people to cover is now a issue.
We have now been told we HAVE to do this and have no choice. They say its in out contract but I cant find anything about on call. What are the legalities with this? Surely they cant MAKE us do it?

Also we dont get paid per hour only if we get calls then about €20 per call.
We get woken up at 5 some mornings or before and then have to do our normal shift in work 9-5.

As someone helpfully pointed out earlier. Have a look at NERA.

As I understand it, you are entitled to be paid when you are on call at a rate equal to 25% of your normal rate.
