Changing name on planning permission

    Hi I would be grateful of some advice if anyone has went threw this process. I am looking into buying a site with planning permission granted but not for me, one of the conditions for granted planning permission is: Dwelling hereby permitted shall be first occupied by one of the following category of applicant as defined in section 2.5.5

    (A) The applicant
    (B) Immediate family member
    (C) Member of indigenous rural community

    I dont know if I should go ahead with buying this site after seeing the planning applic. My home house (mums) is 7 miles from this site would I be suitable to buy. Manyy thanks for any advice and views with this matter.

    For the most part the name on the application is irrelevant as the permission is for the actual plot of land.
    What this appears to be is a local needs residency clause.

    Have you looked at your local CDP and see what constitutes local for your area. You may still qualify...

    A local AT/Arch will let you know if there have been any challanges to them and if succesful. Also, a standard attached condition was that they could be sold if required by banks and mortgages etc.

    Cheers Ray, you are advising me to go to my local architect yes? Could you give me your opinion on my suituation..

    This site I am looking at has all development plans pain and he is looking for 24000. At the minute I only have 50000 to buy a site and build.. My plan is and please tell me if you think I should hold back as I am aware of the many houses about unfinished, I am hoping to build a shed get a small road in and finish the house as and when I get the money.. I am hoping I could have it finished in 6 years... Am I dreaming cheers

    6 years will be outside the life of the current planning permission. You need to check how long is left to run on that first before you can plan on how long it will take you to complete the build. To be honest, €50K is a drop in the ocean in terms of finishing a house, and I'd be reluctant to start such a project without having the funds in place to see it through to a stage where I could move in to it, albeit without it being fully completed.

    Out of your €50K you'll also have to pay Local Authority contributions at commencement stage which vary hugely around the country, so you won't be left with much by the time you've bought the site and paid those.

    I'd be getting some professional advice sooner rather than later if I were you. You need to think the plan through before you commit to anything.

    Thanks for info Supertech, can you advice me of what the local authority contribiutions are for and roughly how much, the man I am thinking of buying the site of has development plans paid and has just renewed the planning premission, it will continute to 2017.. tks

    Most sensible thing is view the planning file and you will see the actual contribution amount due in respect of your designated site. It varies by council and actual site development size.
    50K is a mad amount tbh to be setting out with, as per Supertech, drop in the ocean and will be gone before you start. Grand having the permission extended but no use if you dont get the €€ before the end again.
    My advise is stand back and re-evaluate. There may be completed houses local to the area which will give far better value for the €€ paid and less hassle/stress.

    Cheers guys, Im from donegal My brothers are all plasters, ground workers r plumbers... My prob with looking at house that r built and all is I can never find the 1 that I would want 2 live in for the rest of live:)

    What you need to do is buy the site subject to planning permission. You're going to need a new planning application anyway if you want to be sure, so tell the vendor that you'll buy the site as long as the new planning permission is granted. This is very common.
    I have seen a situation where a house was granted permission for one applicant, then refused when the applicant changed.

    i know of situations where a prospective purchaser has put there case to a planner, similar to the above, and received a letter from the local authority stating that they complied with the local needs requirements. Thus the purchase could go ahead with no problems.

    Im not saying that this is available as an option in all counties, but its worth a phone call at least to the planner.

    There have been many cases of planning offices sending out letters post planning stating that certain conditions can either be ignored or altered.

    Altho with further research into the plans we now think the house that he has planning for may be to big for us its 2400sq and it would be for a family of 5, would we have to go in with a new plan for a smaller house not sure how this works and have been ringing the planning office all day back cant get talking to the right person, can anyone help with this matter, cheers guys

    Yes, you will need to get revised plans and then apply for planning permission for change of house type.

    The planners will only take calls on one morning/afternoon during the week. When you ring in you should ask what time you can get talking to the local planner but if you're in the Letterkenny or Stranorlar electoral areas it will be a Wednesday morning.
