Temporary week by week contract for over 2 yrs, my rights?

    Hi, I've been on a temporary week by week contract for just over 2 yrs now, I was given this contract when I first started and it hasn't changed since. I am supposed to be covering for another permanent employee who has been out long term sick. She may or may not come back to work I don't know. But technically she could walk through the door next week, so I'm wondering basically what my rights are. By the terms of my contract 1 weeks notice is all that has to be given either way. Can someone please help me as i'm quite concerned and worried. :(

    Sorry and I forgot to ask also, can a person who has been out "sick" for such a long time, literally walk back into the office when they please. :confused:

    Ahh, it's more about when their doctor signs them off as fit to return to work than "when they please".

    Have you been applying for permanent jobs?

    Remember, since it's week by week, you are free at any time to say "no, I won't be available next week", when you have another gig to go to.


    NB I've done a role like this: was initially for two weeks, the other person came back after about eight weeks - and by that time I knew enough that the other staff asked if I could be kept around for an extra week to do other stuff ... and in that week, they moved me on to a contract for another six months. I don't know the legalities, but be sure that the temp agency will move you off the role if you start asking difficult questions. So my advice is always to make the best of it, and keep looking for what you really want.

    thanks Justmary for that. I am not with an agency and am employed directly by the company and unfortunately there will be no other jobs available if this girl comes back. I'd note also, that the manager doesn't want her back, her track record was not good, but hands are tied on this one. I would just like to know what the legalities are, I'm not a trouble maker but it would be nice to know. Though I do suspect that I have absolutely no rights at all, even though I'm respected and valued as an employee.
