Lets say you get 90% in all your exams besides one which you fail miserably on both attempts. I'm guessing next year, you'll be capped at 40% for that module no matter how well you do on it but will you still have a good overall average since you got 90% on everything the previous year?

As far as I'm aware, repeating the whole module doesn't mean you're limited to 40% for the overall grade in that module.
Then again, in your repeat examinations in August - unless you have "Illness" on your exam results - your overall mark can go no higher than 40% no matter how well you do.

I'd advise contacting education@dcusu.ie - Aaron Clogher is the Education officer at the minute and should be able to help
