Career Break Appeal

    Hi,

    I have applied for a HSE career break but it was rejected. My manager told me he has been advised by his manager that if it is going to have a detrimental affect on the service then it should be rejected as no posts are being back filled. I was told that by the manager that they would possibly be able to refill my post if i resigned. There is 15 other therapists in the Department so my work would be shared out, its not like the service would be gone!

    Has anyone appealed a rejected career break application?
    What exactly does a detrimental effect mean?
    Any legal things i should be aware of?
    Any help would be greatly appreciated.

    3.32. Career Break
    "An employee can be granted a career break for any of the following reasons:
    domestic reasons, e.g. child-rearing; educational purposes, e.g. to attain a post-graduate qualification; foreign travel"

    "An employee’s application may be refused where it is considered that the granting of a career break would have a detrimental effect on the service"

    First thing - is there a right of appeal in these matters ? To my knowledge career breaks are entirely at management discretion.
    Secondly , your management have a point - they cannot fill your vacant post and the workload on your colleagues increase , perhaps not so much of an issue now but what if a couple of colleagues do the same thing or drop out on Maternity leave ?, in no time at all there will be a detrimental effect on the service to patients.
    Your management may also fear setting a precedent in your case which makes it hard for them to refuse other requests for breaks.

    Hi Delancey,

    Thanks for the information, yes it is at the managers discretion. As far as i know i can appeal the decision.

    Presently there is one person in the department who has taken career break is soon returning - precedence has been set.

    If there is money in the pot to fill a vacant post, why would it matter if it is filled on a temporary basis or a permanent basis? Why if i quit would they suddenly get the money to replace the post?

    Two weeks ago the manager was going to loose one post to another county, and she was asking for volunteers to go to the other county? Why was this not detrimental to the service, but me leaving would be?

    Has anybody successfully appealed?
