    Hi all,

    Just a quick scenario.

    If someone approached a company about supplying say, an item like a worktop. The purchaser told the supplier what they wanted in relation to size, shape, colour and material to be used. The supplier agrees and the person pays for the product upfront.

    What position are both parties in if:
    • The worktop is suppllied and installed while the purchaser is not present. When the purchaser first sees the product in place they notice that the shape is not shape that both parties previously agreed upon.
    • The purchaser contacts the supplier and explains that they did not get the product they ordered. The company agrees with the purchaser and intends to replace the product.
    • 10 months after the delivery and installation of the product, the company still has not replaced the product. Contact has been made multiple times by the purchaser but the company says that his worktop supplier has gone into liquidation and he cannot give the purchaser what they ordered.
    • The company then tells the purchaser that they will have to chase down and deal with the liquidated company.
