Missing logbook, deposit paid

    Hi! Can anybody help me here?

    I bought a car from a colleague of mine one week ago. I trusted him although we have known each other only for 2 weeks. I paid half of the price, 200 Euro, and didn`t write any paper on it. He told me he was gonna find the logbook later. Now he wants the other half of the price. I told him that I won`t give it to him until he gets me the logbook. I am now worried about the whole thing since we did not write any paper about the 200 or anything. Could someone tell me how this works? Shouldn`t we write an agreement or something that the car has been sold to me??

    Why would you not get any sort of receipt of payment? Especially when you only know them two weeks :rolleyes:

    I was just told by 123 insurance company that the car needs to be registered on my name to be able to ensure it.. Is that right?

    There's none but if you were to mention you think you got a few speeding tickets in the car he is likely to get it registered to you sharpish as all fines go to the registered owner. If he can't find it all he needs to do is fill in a form RF104 at the local Garda station, send it to Shannon with the €12 fee and he will have a new logbook in a couple of days. If his name was never on the logbook the whole thing becomes a mess finding the registered owner.

    Go to https://www.motortax.ie/PSE/start.do?page=welcome and check the registration that will tell you about any change in ownerships in the last three months. Your transaction should show up on it if it has been changed over but this wont have been done yet if you havent signed the log book, you will also be able to see if the seller has purchased this car recently and is now trying to sell it to you, in which case you should stay away as it may not have been registered to the seller by the previous seller which would be a mess.

    If it all looks above board explain to the seller it would be in his interest to transfer it to you as any parking tickets etc.. would be sent to him until this is done.

    If he remains the registered owner on a car someone else is driving around he'll get tickets etc you accumulate so he does a strong incentive to get car in your name.

    It's not uncommon for shady people to try to get the logbook with them unsigned and then do what they want with the car.
    Something to keep in mind if you sell it on.

    Hi Gago,

    Yes that right, for motor insurance as the insured person you must be the owner of the car, it is registered in your name (or that of your spouse) in the Republic of Ireland

    Getting back to original question. Ask your friend to give you back your deposit, and take the car back until he gets the logbook replaced, or wait for the logbook and complete the sale. The seller's responsibility is to provide you with logbook, so you sign it, put a date of sale, and it is sent to Shannon.

    As for 123 and being registered owner - it is more related to who owns the car, but i wouldn't go to insure a car until i am sure the logbook was sent to Shannon. Most people insure the car just after sale, and technically they are not registered owner, but since logbook was sent with your details, the date of sale will be recorded in Shannon on new logbook.
    You have every right to ask to see logbook before handing in the money.

    Some companies ask Will, some Is, and the others ask if the car belongs to you. Like i said before you put date of sale on logbook, and Shannon backdates the document to the date of sale as you are registered owner from that date. No insurance company would refuse claim based on the fact that logbook was in the post. Simple.

    By your reckoning, you have to buy a car, and wait four or five days before you can drive it?

    No, the simple matter of fact is as soon as you hand over money, the car is yours. There's always delays etc. with logbooks. You have your cert with your registration on it, you're insured.

    Well I have read all the comments and I am so grateful for everybody posting!
    I now start realizing that I am in deep ****.
    To start with, I need to have own transport to be able to work.. I started this job 2 weeks ago and it does for the moment cause me problems to buy a 400 Euro car :(
    But I needed the car urgently and so I took this opportunity.. Since I had never owned a car before I didn`t now how these things work here. Another thing is that I work 12 hours a day, with very few off days, so I did not really have the time to check this problem out properly I was just happy to get the car this soon and cheap. BTW it is really in a good condition. But the point is that now I have a car, which is not registered on my name, has no insurance, no NCT, no road tax and I have to use it to get to work... I have never did anything like this before and now I am forced to do it. This is a very very inconvenient status to be in.. What do ya reckon I should do??

    You can take out the insurance policy on the car and inform them that you've bought it and you are awaiting the logbook.

    DO NOT drive the car until such time that you have insurance to do so.

    Does this chap have the VLC for the car he sold you? Because, if he does, I don't see why you have a problem.

    Except to say that you obviously shouldn't under any circumstances drive the car until you are insured to do so.

    Well that is what I had believed until today. But 123 told me that I need to have it registered on my name so they will be able to insure me.. And as a matter of fact, they have given by far the cheapest quote for me..

    If you drive uninsured, someone in your place of work will hopefully do the right thing and inform the Gardai.

    As for the €200, as you have nothing in writing, he could claim it was only a deposit, and thus not have to send the logbook to Shannon until you give him the remaining €200 - as that's what I'd do if someone tried to shortchange me.

    Try to find a friend/relative who will have a time to give you a lift/pick you up to/from work, until you sort this mess out.
    Also i assume the car is over 10 years old, and most insurers now ask for NCT cert before sending out insurance cert.

    My advice - give the car back to the original owner, find something decent with NCT, and start from there.
    For now bicycle, or walk, or friend with a car.

    Yes, we've been over this, you've just bought it and it will be in your name.

    The price of the car should not be an issue getting insurance.

    Hey Gago - i insist you think again about this car if it has no nct. 123 will very likely ask for it before issuing cert, so they WILL cancel your policy if you don't send it back. Look around for a car with nct.
    My bro bought 96 golf with fresh nct for 500E. Decent car with no issues. It can be done. Good luck.

    Agreed. If its €400 with no NCT then you can be almost certain it will cost the same again to get it through the test. Not worth it in my opinion.

    Ring up the NCT central centre, and see if they'll let you know if the car has gone through the NCT... I'm guessing it has, and has failed!
