Removing a clamp at University

    Hi,

    I know that normally you could remove a clamp yourself but if you removed a clamp from your car that was parked at your college could they do anything about it?

    Like refuse to let you sit your exams until you paid?


    (I know there is no clamping for the summer)

    It would be a contracted company. They don't know who owns the car.

    If you completed the application procedure for a student or staff parking permit, you entered a car reg on the application. Clampers photograph the clamp and car reg so it is possible to trace any declamping back to a student/staff.

    We're unsure as to the legal ramifications of removing a clamp yourself.

    We're working on the parking problems on campus - believe me, there are many of them and we're well aware of them - but in the meantime you *should not* attempt to remove a clamp yourself for your own sake. It could well just end up worse for you.

    Why not buy your own clamp, put it on at the start of the day and take it off at the end?

    Hey, PJ, this guy's already clamped, I don't remember doing it, do you?
    No, but I noticed its been clamped the last couple of days. Doesn't look like one of our clamps does it?
    D'ye reckon somebody's doing a bit of freelance clamping?
    Could be. I'll mention it in the office. Still, he's been there for three days now, looks like he'll have to pay twice, we'll put one of ours on as well.

    You can buy miniclamps and put them on each wheel although it would be easier to cover you wheels in that waxy grease stuff to deter clampers.

    Hi there,

    Did you know that most of the security people are retired guards and do you really think that the head of security or the APCOA company wouldn't be able to find out who owns a car? By time you start cutting there would be someone round in 2min, there is CCTV in most of the car parks, I'd be finding out which ones don't.
    My advice is pay for a permit for peace of mind. Save for it as soon as you can, when you return in September there is so much you have to get like books, stationery, clothes, shoes etc, get a jar and try and put a euro into it every week and you won't be long in having your parking permit, a euro a week for a year wouldn't hurt anyone.
    I think everyone both students and staff hate paying it and for what? You get nothing in return not even a guaranteed space!

    If you feel the clamp was unfairly given you can contact the SU with your information, and photos if possible and should you wish your case can be put forward to the clamping appeals committee.

    Just to lay out the whole clamping scenario here. This applies to any private carpark and clamping body that is not a county or city council (basically any carpark run by APCOA, NCPS or any other private clamping body, not just NUI Maynooth)

    there are currently no laws in Ireland that side for the legality of private clamping, it opperates in a grey area of the law which has not yet been clarified despite attempts by the government The Journal Article . Most opponents of private clamping site the Road Traffic Act Section 113 that says a vehicle cannot be interfered with.

    The legal concensus is that if you can remove a privately owned clamp without damaging it that no offence has been committed even if you are on cctv or in the presence of witnesses (The gardai will tell you the same thing) . There are methods to do this rather simply which I cannot explain in this thread as per the warning.

    Removing a private clamp by causing it damage however can carry a criminal damage charge, and a theft charge if you choose to keep the clamp. Nobody has thus far been brought to court in Ireland for this, and you owning the car from which the clamp was removed is no evidence to prove guilt. If you choose to remove a clamp by causing damage be prepared that CCTV or witnesses may work against you.

If you had actually read the post my advice was to get a permit and how to simply save for one without breaking the bank at the start of terms. I am of the the opinion you simply have no clue what you're talking about and for that reason should MYOB.
    Censorship must be alive and well in this country and if you choose to give me an infraction because you can't handle the truth then you my dear are not impartial and should not hold a position of a moderator. This site speaks of educated ideas and with this in mind we are all entitled to freedom of academic speech. It were others who offered advice on how to remove the clamps.

    I think the mod clicked on the wrong name. I see that he/she edited frozenfrozen's post Yesterday at 14:02. Maybe the infraction was meant to be for whatever was there.

    Either way, removing a clamp without damaging it is totally fine to post. The line is crossed when someone says to cut the lock or whatever.

    Fasttalkerchat is right - I accidentally clicked on Sophie_'s first post in this thread when I meant to snip another. Too many new buttons, I got confused :o The post was not changed at all though. Warnings/infractions appear as a yellow/red card beside the post; editing a post is not an infraction.

    All you have to remember is to inform them that you have their clamp and will return it to them undamaged.

    So presumably the infraction has been removed.
    No one could blame anyone for being annoyed when they know full well that the mod has made a mistake. It would be rather stupid to give someone an infraction for speaking their mind. No bad language was used although I am still of the impression that you made a mistake and you should own up to it and remove the infraction. Mind you I dont spend much time on this site but I do like to help students when I can.

    Seren's "owning up" as you have put it has already happened if you care to check post number 17 of this thread. She has apologised for what was in essence a keyboard slip as Mods have more buttons appear on their screen at times (i cannot tell you how many times i've hit edit on a poster rather than quote). We are holding nothing against you for being annoyed Sophie, one can understand that position. The issue however is how you handled the situation in this thread and how you spoke to the poster Seren upon the accidental infraction.

    Any further issue may be taken to PM to any of the Mods on this forum and a re-reading of our forum charter may be due
