Parking Ticket

    Hello all, I live in Roscommon, and today received a fixed charge offence of €40 for parking in Harbour Rd, Skerries, on 5th June 2012.

    How do I prove that I was not in Skerries on that day?

    The letter from Fingal CoCo goes on to say that if fine is not paid then legal proceedings will be brought against the driver, how can they prove I was the driver when I was in Roscommon at work on the date and time of alleged offence?

    They don't have to prove you were the driver. They prove you are the registered owner of the car that was parked.

    are you trying to get off the hook by saying you were not driving or are you saying you are sure the car wasnt there?

    I'm saying I never parked the car there - my brother had the car for that week. Am I still liable as it says in the letter they are going to proceed against the driver.

    Yes, you are liable as it is your car.

    Get your brother to pay you the amount of the fine.

    This happened my sister recently. Some one else parked her car and got done.

    Letter was addressed to her but in the form she got to declare who was driving the car at the time.

    Ticket was issued by Gardai

    It's pitch black at night on the Harbour road in Skerries - it's tantamount to entrapment. You know as well as me it's just a form of making money.

    If it was pitch black maybe he was parked dangerously.

    I have pics taken by council, it was parked fine. When will you people not just accept the council want your money.

    Ah please. In summer it is not pitch black until about 3am.

    So, maybe someone needs the services of an optician, to see the signs that are very clear.

    Yes, it's a form of making money, but if you abide by the rules (pay and display) then you don't have to pay that extra of €40. Next time, your brother should follow the regulations.

    I have never received a fine for parking, in all my years of driving. I simply make sure that I pay the correct fee in the first place. It's really not that hard to do.

    You weren't driving the car at the time, your brother was. The fine gets issued to the registered owner of the vehicle. He's at fault not you. Get him to pay up...simple.
    What parking at night time has nothing to do with it.
    It would be better to put your frustration towards your brother for using your car that way instead of the users here.

    Ah listen, if the lad isn't local, it's hard to know every place you are not allowed to park in. I'd advise the OP to just pay the the fine, it's only €40 and take it as a lesson to be more vigilant.

    Okay in this case the council don't care who was driving - in the case of penalty points etc for speeding etc you can declare someone else was driving

    They have issued the fine(fine only no penalty points) to the car owner - you, so you need to pay it and by pay it i mean get your brother to stump up the 40 euro. if he doesn't then show him the door the next time he wants to borrow the car

    BTW what about tolls - did he pay any that he may have went through Otherwise you may be getting some more demanding letters!!!!

    Harbour Road, Skerries, is fairly well lined and signposted as to hours of parking, etc. All are clearly marked pay and display areas. Have a look at the street view on Google maps.

    From the posts, I assume the OPs brother either didn't pay and display or else his period expired and that's what the fine was for.

    Yeah, it's only €40, and a lesson for next time. Either the OP pays it, gets the brother to pay it, or else prepares to end up in court and try to defend it there. Fingal Co Co will follow it up. Usually, it's better to just pay the fine and move on. Life is too short. :rolleyes:

    If you send your brothers details to the parking fines section of the council they'll re-issue it to him as per the RTA below


    (4) Where—
    (a) a notice under this section is served on the registered owner of a mechanically propelled vehicle or affixed to such a vehicle, and
    (b) the registered owner of the vehicle was not driving or otherwise using the vehicle at the time of the commission of the alleged offence to which the notice relates,
    the registered owner shall—
    (i) not later than 28 days after the date of the notice give or send to a member of the Garda Síochána or a traffic warden at the Garda Síochána station or other place specified in the notice a document in the prescribed form signed by the registered owner and stating the name and address of the person who was driving or otherwise using the vehicle at the time of such commission, and
    (ii) give or send to a member of the Garda Síochána or a traffic warden within such period as may be specified by the member or warden at the Garda Síochána station or other place aforesaid such other information within his or her knowledge or procurement as the member or warden may reasonably request for the purpose of identifying, and establishing the whereabouts of, the person referred to in subparagraph (i) of this paragraph.
