Question about Employers

    Here are some legal "facts" and questions that I'm curious about and if they are actually true or not and i was wondering if some light could be shed upon them.
    • An employer has to tell you what hours you are working (part-time work) a wek in advance.
    • Workers are entitled to have some paid holidays over the course of a working year.
    • Can an Employer fire you for wanting to take holidays?
    • What actually happens to employers who are found the be employing people who are kept "off the books"?
    • Are staff entitled to take Bank holidays off and politely refuse a request to work on one from an employer?

    I'm just wondering if anyone has had any experience with these types of things and what happened. Thank you.

    2: Of course. You get 8% of the hours you work as holiday hours. You work 100 hours, you're entitled to 8 paid holiday hours.
    3: No.
    4: Not really sure, I assume revenue would investigate and they would have to pay the relevant taxes and possibly a fine. I don't know if there are any other consequences.
    5: I don't think so but I don't know.

    Your contract should cover some of these areas.

    1. Dunno. There would presumably be an element of being reasonable anyway, like covering for someone who was sick.
    3. No but you will likely have to agree to take them at a time that suits the employer. You can't just give the employer a list of dates and say you won't be showing up. Expect to be fired if you do try it. You couldn't have everybody off at the same time, or during an extra busy period. In some businesses you have to take holidays at a certain time. Waterford Crystal people all had their holidays at the same time so that the plant could be shut down and the machines cleaned.
    5. No. Your contract should state that you are required to work bank holidays. Your local Spar will be open on a bank holiday so you can't have the staff all not showing up. You are entitled to either a replacement day off instead or to extra pay.
