    Hi there ,
just wondering if someone can help give me some advice , i recently bought a vintage designer bag on Adverts.ie about 2 weeks ago and sent payment via bank transfer to the seller in Cavan , who seemed really nice and had positive feedback.
Anyways to cut to the chase I still haven't received the bag , first the seller kept coming up with excuses as to how they didn't get to post it then they said they posted it on Wednesday last but lost the tracking number !!! I have been in contact with another girl who also bought and paid for a designer bag off of this seller a month ago and is still waiting to get the bag as seller said they posted it twice but the bag was returned by An Post but yet no delivery note was left on either occassion ! Between myself and the other buyer we have paid this seller €900 .
She is now ignoring my pm's and the moderators on the site has contacted her telling her to sort it out or they'll recommend I go to the Gardai ,they have also suspended her account . Basically I jus need to know where do I stand legally on this , I have her name , bank account details and I think the other girl has her address and phone number , I just need to know can she get away with this ? Can I go after her for my money ? Any advise would be apreciated :) Tks

think you might have to go via the SCC route.

would that be a lenghty process to take it to small claims court , would I need a solicitor ?

I'd go to the guards before going to court.

I was hoping for the matter to be settled so I wouldn't have to go to the Gardai but she's not leaving me much choice , I just seeen on a few threads on the averts.ie support forum on here that a few people that have gone ot the Gardai have had little or nothing done , they make the report and in some cases the Gardai didn't even get back to them , has anyone had to do a similar report and if so how did they get on ?

Go to the Gardai and at the same time apply as much pressure as possible without intimidating her. If you have an address go there, call her twice a day. Apply the same pressure you would to anyone who owes you money and doesn't.
You are entitled to your money back.

I'd be very careful about this or OP might be the one getting visits from the gardai. Don't take matters into your own hands, OP, go the official route at all times.

I'm way pass that , I reported her over a week ago and in fairness to the mods they've been great . They suspended her account and have beeen pming her to get her to cooperate and also told her that if she doesn't they are recommendine I go to the Gardai and that they will work with the Gardai to get it sorted but she's either mad as a box of frogs or thick skinned !

Contact your bank and report the payment, The bank might not be able to do much but the fact you reported it will stand you if you go the SCC or Garda route.
