Car Insurance question

    i have my own policy with my wife as a named driver, a few weeks ago my wife was hit by a car and the elderly lady driving the other car passed away soon after.
    her insurance company will not pay out and i have been forced to claim from my own policy. This has now been arranged and the claim has completed. I have my NCB protected through an additional add on to my policy.

    My question is we are now looking to get an 2nd car and as i have a policy already i will take the new car policy out under my wife's name with me as a named driver. So as my wife was driving the car when the lady hit her and we have now claimed from my own policy when I am looking for a quote for the new policy for my wife on the new car who has the claim recorded against is it me or my wife or both of us? Or as i have my NCB protected does this effect us at all?

    Your wife will be obliged to inform her insurer when incepting the policy that she has had a previous claim.

    On what basis did the other insurer refuse to deal with your claim on?

    Did they contest liability?

    Just because the Third Party is dead doesn't mean they can walk away from her liabilities. They accepted them when they took her on.

    In the event that they refused your claim on the grounds of liability then you will most likely (or your wife will) have to disclose an at fault claim made which will hit her premium.

    Just because the third party is dead doesn't mean you can't sue her insurer.

    You will need to take a second policy out under your wife's name or a new one in your own with no NCD. As for the claim, the other insurance must have decided that your wife was at fault.

    You could kind of do with helping me out here dude. How is a Road Traffic Accident an act god?

    That doesn't make sense in a claims environment.

    Sounds like your typical Irish motorist - blame the other guy. Oh and God was party to blame as well!

    And then she goes and dies, the lengths people will go to to protect their NCB!
