    Remember this?

    tagautavia.jpg

Well, it arrived Friday..or should I say the box, warranty card, manual etc arrived..but no watch

Vendor said it was in the box and indeed the Parcelforce weight indicated it left 165gms heavier than it arrived...

So some ba5t4rd nicked it between there and here

Sent vendor pictures of packaging etc, got in touch with An Post and the vendor is getting onto Parcelforce.

I am right in assuming that I am entitled to my funds regardless.

    Really p11sed about this...

That is unbelievably upsetting. I haven't heard of this happening. I'm guessing it wasn't insured? I have no idea about responsibility?

Hope you get you're money back

EDIT: Well obviously I can imagine the delivery service is responsible, but I have no idea who will be stung financially

Hi DT that's such a bummer. Hopefully you get a quick resolution to this. :(

I paid £70 to have it shipped insured...but ultimately its the vendor job to get funds back from parcelforce...they should refund my cash via Paypal asap ?

Usually the shipping contract is with the seller rather than the buyer; parcelforce std terms and conditions exclude compensation for watches (not unusual). If the seller charged you for "insured" shipping and he didn't arrange it that would sound like a breach of contract. Where was it being sent from and was the seller doing so as a business?

    mmmm...

Not sure now if the 70 was insured....

At the end of the day though...I am entitled to my cash back..and its their job to deal with compensation claims..correct ?

yes, they sent it and unless you took responsibility yourself for its safe arrival, it is the sellers liability

Was it a business or private sale?

You'd better dig out the website and any Ts and Cs. It's not necessarily a case that "I didn't receive the goods so I get my money back". It will be determined by the terms and conditions of the sale and consumer law applicable to the transaction (which may not be Ireland of the goods originate overseas). Whether the seller was acting in the course of a business or not will be relevant a to whether consumer protection law applies.

You'll see on many watch forums that the selection of particular delivery services is recommended as some cover watches if stolen and others don't likewise as you paid via Paypal, their rules might afford a higher level o protection (e.g. If they are bound by similar rules as credit card companies).

This is an area to be careful with as many private sellers will specify that delivery risk is taken by the buyer not the seller.

It was a private sale, and covered by Ebay buyer Protection.

I had to open a case with Ebay and they are is discussions with Parcelforce

Well you may all remember some time ago I bought a Tag Heuer Autavia

When the package arrived everything was in it..EXCEPT THE WATCH :(

Spoke to vendor etc... Claim made against Shipping agent etc...

Raised a claim with ..waited and waited...and now

They want me to raise a police incident report

I am hoping that this is the end of it and I can get my cash back....:D

    I wanna buy something else....

I know I read this before but my first tought is how did you pay?
Was it a private sale or a shop sale?
Credit card will protect you in this
Did the seller not accept that it was his duty to get the watch to you. It was your duty to the Get money to him. That is what I always expect
Why is it now your responsibilty to do this. You fullfilled the part of paying him.
I truly hope this ends well.

You bought it from the UK which is whythey expect to receive "police incident number". In the UK, you generally ring and give the cops the details and they give you the number over the phone. Hopefully, this is all they need to process it.

Yeah my wife bought something in the UK from a 'Shop' website that never arrived, and she had to report it to the UK Police (I think in this case though it was fraud squad) They just gave her a number over the phone which she was able to use to get the money back from credit card company.

    Excellent!!!

Good to hear that this has ended well (ish).

I'd have been reluctant to purchase a watch of any value through ebay otherwise.

    So....whatcha gonna buy next???????

I think eBay / Paypal are brilliant for that sort of thing - once you're not the seller.

That steinhart looks gorgeous. I'd just be worried about the big crown on a 47mm watch. Maybe it's just the one I got, but I find it digs into the top of my hand quite a lot. Looks very cool though.

Justice would be the thief being hunted down and forced to wear the leopard print Rolex the rest of their life.
    Cruel and unusual!
