no insurance summons

    Hi All,

    My brother is in a bit of bother. He was bringing his girlfriends car to be serviced. His friend is a mechanic that lives less than a quater of a mile away.That he was bringing the car to be serviced.

    He has his own van and open drive insurance. (commercial insurance)

    He use to own the car he was driving to be serviced.He gave it to his girlfriend and paid her insurance.

    However while bringing the car to be serviced. He was pulled in at a check point. He was told to produce his insurance and licence. He produced his licence and his own commercial insurance.

    However he got a summons today for failing to produce insurance.

    Need advice for him as he is very upset and fears he will lose his job as a driver if banned.

    Commercial insurance does not cover other cars. There is nothing he can do really. He should have put himself on the policy as a named driver.
    If it's a first offence he should not get banned.

    This happened to me once when i was driving someone elses car.

    he should get in contact with the prosicuting guard and show the part of the certificate for his commercial insurance where it says he's insured to drive other vehicals.

    you might find though that he might only be insured to drive other commercial vehicals and not private ones?

    under her insurance is he covered as a named driver?

    He has a driving offence. But not for driving without insurance.Will this effect him

    I can't answer that, depends on the judge on the day. His other offence might be a factor in any decision the judge makes.

    Failure to have motor insurance or driving without insurance in Ireland is generally punishable by:
    •A fine of up to €2,500
    •Disqualification of one year or more for a first offence and two years or more for a second offence, and
    •At the discretion of the court, a term of imprisonment not exceeding six months.

    In the case of a first offence of driving without insurance, the court may decide in special cases not to impose a period of disqualification or to impose a period of disqualification of less than a year.

    Since 1 June 2003, where the courts in Ireland decide not to impose a disqualification, drivers convicted of a first offence of driving without insurance will incur 5 penalty points on their licence record in addition to any other penalty imposed by the court.

    If you commit a second offence for driving without insurance, you will be automatically disqualified from driving. You should also note, that where a member of An Garda Síochána (Irish police force) believes that a vehicle registered in Ireland (or outside Ireland) is being used in a public place without insurance, the vehicle may be impounded.

    I am calling to visit him . Ill explain what ive read here to him.

    Any more info on what to expect or any more advice.I would appreciate.

    Tell him not to worry too much about it. It might not be all bad for him, probably just a fine.

    The best advice you can give him is to engage a solicitor, it's a serious offence so he definitely needs professional advice and representation in court.
