county council levy - does this have to be paid

    I am considering applying for planning permission and one of the things which i have to consider will be the levy from the county council for local ammenities etc. They are charging circa €13k in meath. Now I know it says that it is for local amenties but the nearest playground is over half an hour away, the roads are in a very bad state and there is no sign of them been upgraded. What happens if you dont pay the charge to the county council? can they pursue you legally or will they go after you if and when you sell the house? I have been hearing all kinds of stories but dont know what to believe

    while this threads very close to breaking charter rules, ill let it run to see where it goes.

    Remember that under no circumstances can we discuss how to 'get round' any legislative or regulatory function.
    What happens if you dont pay the charge to the county council?

    1. its a condition of planning, so if you dont pay, you cant get the work 'signed off' and thus, probably, no mortgage money drawn down.

    2. usually the condition states "prior to commencement" you must pay, but there are instances where the council will accept a staged payment plan. this needs to be agreed with the council prior to commencement.

    3. if you dont pay, or dont enter a staggered payment schedule, theres a real chance the council will come after you and stop your work on site until you do pay. They have the power to do that. Remember that the councils have feck all money so there will pursue every avenue they can for funds. this 'stopping work' WILL cost you extra money.

    glad i didnt break any forum rules! I know for a fact certain cases where people have finished their house and are living in these without paying all of the levy. At the same time in one of these cases the solicitor is aksing to see if the levy has been paid. dont know exactly where he is coming from. May have something to do with the bank and the mortgage.

    The council send out threatening letters , with possiblity of court action.
    They start looking for the money as soon as you give them notice taht you are starting to build. I split mine in 4 payments, was a couple of weeks late for one...nasty letters!!!

    Just to point out that the Council wont allow you to connect any of their services unless you have paid in full or entered into an agreement to pay in installments.
