PRTB+Lease

    Hi Guys,

    My landlord is not registered with the PRTB and is refusing to do so, from what I can make out, this means he is not declaring the income tax on the property and it also makes the lease void?

    Just looking to confirm this.

    Whether or not he pays tax is his own business and has nothing to do with your lease (unless he lives abroad, in which case it up to you to retain a percentage of the rent to be paid as his tax).

    If he is not registered to the PRTB then you as a tenant are still covered by them, and if you have reason to do so you can report the landlord to the PRTB as not being registered and let them deal with him.

    Your lease is completely separate to the landlord's tax affairs. You are bound by the terms of your lease, that's what you signed up to.

    People can be PRTB registered and not show on the register for months and months - there is a huge backlog. The register is also full of incorrect addresses. Not showing on the register does not indicate the tax status of your landlord and as the previous poster said, the tax status of your landlord is not something that should bother you.

    Just make sure you include his PPS number (or name and address) when applying for your rent credit - that's all you can do from your side.
