Bank Holiday Pay???

    Hi,

    I am employed full time 45 hours a week in my current job.

    The shop is open every Bank Holiday for 4 hours. If you work it you get paid time and a half.

    If you don't work it you get paid 8 hours BH payment.

    My understanding was that by working it I would be paid 4 x 1.5 + 8 = 14 hours

    However I was only paid 6 hours.

    This seems mad because, if I don't work at all I get paid more money than if I come in and work 4 hours.

    Is this right?

    In my old job our Bank Holiday hours were double time for whatever was worked and normal hours after that (up to 8)

    Examples:

    Worked 4 hours = 4 @ double time & 4 @ normal rate
    Worked 2 hours = 2 @ double time & 6 @ normal rate
    Worked 8 hours = 8 @ double time & 0 @ normal rate.

    It seems you should have got 4 @ 1.5 time (6) & 4 @ normal time = 8 hours in total.

    Whatever way they worked it, it seems ridiculous to pay me less money for working than taking it off.
    Just wonder is there anything illegal about it?

    If you are required to work on a public holiday, you are entitled to one of the following:

    An addition day's pay
    A paid day off within a month of the day
    An additional day of paid annual leave


    So your employer is in the wrong here.

    Not wrong in all cases. In the retail industry pay for a BH is normally 1.5 time. In the PS and industries such as Banking & Semi-states the rate is as you listed.

    Have you a link for that? I'm not saying you're wrong, just that I've never heard that there's a difference depending on industry before, and google isn't bringing up anything.

    I am in a position that I can chose what days I work.

    I presumed I would get T1/2 plus 8 hours otherwise I wouldn't have bothered.

    As it stands I was paid 6.75 hours (4.5 x 1.5), had I chosen not to work I would have been paid 8!

    The HR girl said "if you get paid at higher rate you don't get 8 hours as well"

    I presume "higher rate" is T1/2.

    So it's better to be paid the lower rate..i.e. 4.5 + 8 =12.5 hours instead of 6.75

    Almost right. Citizen's Information says http://www.citizensinformation.ie/en/employment/employment_rights_and_conditions/leave_and_holidays/public_holidays_in_ireland.html
    • A paid day off on the public holiday
    • An additional day of annual leave
    • An additional day's pay
    • A paid day off within a month of the public holiday
    One exception is part-time employees who have not worked for their employer at least 40 hours in total in the 5 weeks before the public holiday.

    So the OP didn't get a full additonal day's pay, but should have done.

    The HR woman needs to be reminded of the above.

    I would assume they get paid for the hours they work (4 in this case) and the "additional day's pay" is the 8hrs bank holiday pay.
    So if they have an agreement to be paid time and a half on bank holidays they should get
    4 x 1.5 + 8 x 1

    i got paid flat 8hours if i am requested to work a Bank Holiday and than have an option of taking a day off that week or getting paid for the 6th day ur lucky time a half or even double is very seldom nowadays employers will pay

    We stay open for the whole day on bank holidays. Those who are off but still get bank holiday pay get paid normal rate of 8 hours and those who're working get the pay for that shift doubled. Not sure if this helps your case or not but I thought I'd share what I know just in case.

    I work office hours, and am usually off BHs but if I have to work them abroad etc, get two days holidays as compensation.

    Bizarre the different approaches.
