Planning Exemptions for rear extension

    I am looking for clarification of one of the points in planning exemptions for rear extensions.

    The specific point is:
    "If the rear wall of the house does not include a gable* the height of the walls of the extension shall not exceed the height of the rear wall of the house."

    My house does not currently have a gable wall at the rear. I am hoping to build an extension with a gable wall which is parallel to the existing back wall. The apex will start at the level of existing back wall. Does the above stipulation include the apex? i.e. is the apex included as part of the wall height?

    Yes the apex is included as part of the wall height

    You extension apex can be set no higher than the existing wall height - or to put it another way the apex should slot in under the existing rear gutter line .

    Thanks for your reply. I suppose it makes no difference if the gable wall is actually a window from ground floor to apex?

    The development plan in my county won't permit me to build on the side of the house without increasing my site to something ridiculous. If I submit plans for an extension at the back that don't qualify for exemption am I bound by the regulations of the county development plan?
