Need advice regarding damaged car

    Hey guys,

    Long story short, a lady reversed into my car last week. She left her name on the car but did not report it. A witness saw the whole thing. I rang her and she said that she did not cause any damage. I told her that she had caused damage to the front wing and bumper. She refused to come up and examine the car and told me to get a quotation for the work as she did not want to go through insurance.

    I rang her back on Monday with two quotes from two different repair shops. Both are over a 1,000 euro. She did not accept the value on either quote and rang a guy she always deals with. He rang me and went through the quotes and based on that, is in the process of doing his own estimate. I know that this will end up being cheaper as he knows her already.

    My question is:

    Where do I stand?
    What rights does she have?

    The two quotes that I got are from reputable garages who are both licensed to do insurance jobs. I want to go with the more expensive quote because I know that they will do a good job. How can I make her pay for this?

    Should I tell the guards, and if I do, what can they do?

    Sorry for all the questions, but really feel wronged here and not sure what to do.

    Did she leave her insurance details also? If not, ask for them.

    If she wont stump up for the quote you want to go with, tell her you're going through her insurance. If she won't give them to you, escalate it through the Gardai

    Inform your insurance company right away no matter what and give them any details you have of the woman such as her car reg number.

    She has the right to get her own estimate, but you don't have to accept the garage she chooses. However if your estimate is a lot above hers then there could be an issue.

    It's quite possible she knows a reputable garage who will do the job cheaper and as good as yours, play it by ear for a day or two and see what happens.

    Not if you're unhappy about it, if their work is potentially not up to scratch.
    Also, if I go through insurance, do they nominate a garage or can I go with my original?

    You can go with your original. Normally they send out an assessor, and they decide how much you get, you get a cheque and can do with it as you see fit.


    Like I said, contact your insurance company straight away.

    Don't have any further contact with her. Do you have her insurance details? If so, then simply claim through her insurance, if not then report the matter to the Gardaí and let them get her insurance details for you. You were obliged to report this to your ins co last week, so do it straight away.
    Also, if I go through insurance, do they nominate a garage or can I go with my original?
    Providing it's insurance-approved then you can have a garage of your choice do the work. Don't forget that you'll need a replacement car while yours is being repaired.

    I should have mentioned that I did report it to my insurance company the day it happened. Here is the hilarious thing:

    I was with Aviva at the time and I informed them. My insurance was due for renewal three days ago and I changed companies to FBD. Do I now need to also inform them?
