    lads i posted this on another forum for someone who was asking about moving
    live wild rabbits

    Yesterday at 7:14pm,
    "(1) A person who is not a licensed wildlife dealer shall not keep for sale, sell, transport for the purpose of sale or exchange, offer for sale or exchange, purchase for resale or exchange or engage in taxidermy in respect of fauna, at any stage of life, set out in Part I of the First Schedule to the European Communities (Natural Habitats) Regulations, 1997."

    and this is the answer i got back

    that only applies to animals that are not vermin, e,g badgers, deer, hares, hawks, e.c.t. it doesn't apply to rabbits, foxes, rats crows minks, e.c.t,

    I may be wrong but the definition of fauna being somthing along the lines of 'Animals, especially the animals of a particular region or period, considered as a group'. I would have thought that rabbits and other vermin would still be considered fauna so would be covered by that. Unless there is specific mention that vermin are excluded I wouldnt say its allowed.

    It applies to fauna and there is a definition of fauna in the Wildlife Act
    "fauna” means all wild animals (both aquatic and terrestrial) and includes in particular wild birds, wild mammals, reptiles, non-aquatic invertebrate animals and amphibians, and all such wild animals' eggs and young, but in relation to fish or aquatic invertebrate animals (or their eggs or spawn or brood or young) only includes fish and such aquatic invertebrate animals which are of a species specified in regulations under section 23 of this Act which are for the time being in force;

    So that legislation applies to all wild animals.

    I asked the npws a while ago back about this as I was having a debate with someone about trapping and relocating foxes or rabbits. I have an email kept from them that says as long as they are not protected species and the traps/cages used conform to legal standards and you have the landowners permission,you can catch and relocate

    I dont think that any animal is classed as "vermin" in Ireland.

    Legally no, but it is a common phrase in the Irish Hunting vernacular

    If they are causing damage with or without a season and are not protected , then they are Vermin!!!! And can be shot ......simple

    It applies to all animals - but it's only talking about buying / selling / exchanging...........if releasing / relocating and no money changes hand then okay.

    If selling / buying you need a Wildlife Dealers Licence

    As far as I can find out, and I'm open to correction on this, it is illegal to transport/move/introduce/re-introduce wild animals to or from any location without a licence from the NPWS, regardless of money changing hands.

    Can you share your source?

    The NPWS have sent e-mails stating the complete opposite.

    i just got an e-mail back from npws its only protected animals u need a licence for
